| Market | Status / focus | Key requirements / change | Effective date / timeline | Official sources |
|---|---|---|---|---|
| European Union | EU baseline | For nicotine-containing consumer e-liquids: maximum 20 mg/mL; refill bottles up to 10 mL and tanks/cartridges up to 2 mL. Article 20 notification and safety requirements apply. National restrictions may be stricter. | TPD framework in force | |
| Poland | In force | The prohibition on sales to under-18s and on internet and vending-machine sales also covers nicotine-free e-cigarettes and refill containers. | Extension effective 5 July 2025 | |
| United Kingdom | In force + upcoming | Single-use vapes cannot be sold or supplied, with or without nicotine. New rules covering all vaping products extend age-of-sale restrictions and restrict promotional free distribution and substantial discounts from 29 October 2026. | Disposable ban: 1 June 2025. Broader retail rules: 29 October 2026 (upcoming). | |
| Belgium | Disposable ban | Disposable e-cigarettes are prohibited. Reusable products remain subject to applicable Belgian and EU product requirements and notification rules. | Disposable ban: 1 January 2025 | |
| Netherlands | Flavour / sales restrictions | Only tobacco-flavoured vapes may be sold. Consumer distance sales are prohibited; the ban also covers offering products for distance sale. | Flavour retail ban: 1 January 2024. Distance-sale offering ban: 1 July 2026. | |
| France | Disposable ban | Offering, selling, distributing or giving away disposable e-cigarettes is prohibited. The restriction covers devices that cannot be refilled with liquid, including those with rechargeable batteries. | In force at review date | |
| Germany | Excise duty | Liquids treated as substitutes for tobacco products are subject to German tobacco excise. The applicable rate is EUR 0.32 per mL from January 2026; product-compliance obligations apply separately. | Rate effective 1 January 2026 | |
| Sweden | Notification required | Manufacturers and importers must notify electronic cigarettes and refill containers through EU-CEG six months before placing them on the Swedish market. Notification alone is not a product approval. | Six-month pre-market lead time | |
| United States | FDA authorisation | New tobacco products, including ENDS, generally require FDA premarket authorisation. Check product-specific marketing orders and applicable state/local rules; submitting an application does not itself confer authorisation. | Product-specific federal framework | |
| Canada | Federal / provincial rules | Federal rules cap nicotine concentration in vaping products at 20 mg/mL. Product safety and labelling requirements apply; provincial and territorial restrictions must also be checked. | Federal concentration limit in force | |
| Australia | Therapeutic / pharmacy route | Vapes are supplied through pharmacies for therapeutic purposes. Subject to state/territory rules and pharmacist assessment, adults may obtain eligible products at or below 20 mg/mL without a prescription; this is not a general retail authorisation. | Pharmacy framework; adult non-prescription pathway from 1 October 2024 | |
| New Zealand | Retail restrictions | Disposable vaping devices are banned. Retailer notification requirements apply, and promotion through gifts, rebates or purchase-linked rewards is restricted. | Disposable ban / promotional changes: 17 June 2025 |

| Market | Status / focus | Key requirements / change | Effective date / timeline | Official sources |
|---|---|---|---|---|
| Poland | Regulated | Maximum nicotine concentration: 20 mg/g. Sales to under-18s, internet sales and vending-machine sales are prohibited. Products require notification six months before market placement. | Sales rules: 5 July 2025. Six-month notification lead time. | |
| United Kingdom | Upcoming | From 29 October 2026, nicotine pouches are covered by UK-wide under-18 sales and proxy-purchasing prohibitions, alongside restrictions on promotional free distribution and substantial discounts. | 29 October 2026 — not yet effective at this review | |
| Belgium | Market ban | Placing nicotine pouches on the Belgian market is prohibited under the Royal Decree of 14 March 2023. Tobacco-free does not mean exempt from the prohibition. | Ban in force | |
| Netherlands | Sales ban | The sale of nicotine pouches is prohibited. The total sales ban applies regardless of nicotine content. | 1 January 2025 | |
| Denmark | Regulated | Maximum 9 mg nicotine per pouch. Only tobacco and menthol flavours are permitted; standardised packaging requirements apply. The sell-through transition has ended. | Rules from 1 July 2025; full retail compliance from 1 April 2026 | |
| Finland | Regulated | Maximum 16.6 mg nicotine per gram; pouch weight 0.5–1 g. Permitted characterising flavours are tobacco, menthol or mint; flavour combinations are not permitted. Notification and Finnish/Swedish labelling requirements also apply. | Product requirements from 1 February 2026 | |
| France | Domestic ban | Domestic import, possession, offer, transfer, acquisition and use of oral nicotine products are prohibited. Manufacturing and export rules are outside this summary and require separate verification. | Domestic prohibitions from 1 April 2026 | |
| Sweden | Notification required | Manufacturers and importers must notify tobacco-free nicotine products six months before market placement. Each brand, flavour and strength must be notified separately; notification does not constitute product approval. | Six-month pre-market lead time | |
| United States | FDA authorisation | Nicotine pouches require product-specific FDA marketing authorisation. Consult the FDA's current authorised-product list rather than assuming a brand's entire range is authorised. State and local requirements also apply. | Product-specific federal framework | |
| Canada | NRT / pharmacy route | Authorised nicotine pouches are regulated as nicotine replacement therapies. Pharmacy sales require pharmacist involvement; permitted flavours are limited to mint and menthol. This is not an unrestricted consumer-product route. | Additional NRT measures introduced August 2024 | |
| Australia | Consumer sale / import ban | There is no lawful consumer pathway to buy or import nicotine pouches. Retailers, including online sellers, cannot sell them; medical practitioners cannot prescribe them and pharmacies cannot make or supply them. | 24 July 2026 |
Read the units carefully. mg/mL describes a liquid concentration; mg/g describes a pouch-material concentration; mg per pouch describes nicotine in one pouch. These limits are not interchangeable.
